Murphy’s war law

  • Friendly fire – isn’t.
  • Recoilless rifles – aren’t.
  • Suppressive fires – won’t.
  • You are not Superman; Marines and fighter pilots take note.
  • A sucking chest wound is Nature’s way of telling you to slow down.
  • If it’s stupid but it works, it isn’t stupid.
  • Try to look unimportant; the enemy may be low on ammo and not want to waste a bullet on you.
  • If at first you don’t succeed, call in an air strike.
  • If you are forward of your position, your artillery will fall short.
  • Never share a foxhole with anyone braver than yourself.
  • Never go to bed with anyone crazier than yourself.
  • Never forget that your weapon was made by the lowest bidder.
  • If your attack is going really well, it’s an ambush.
  • The enemy diversion you’re ignoring is their main attack.
  • The enemy invariably attacks on two occasions:
    when they’re ready.
    when you’re not.
  • No OPLAN ever survives initial contact.
  • There is no such thing as a perfect plan.
  • Five second fuses always burn three seconds.
  • There is no such thing as an atheist in a foxhole.
  • A retreating enemy is probably just falling back and regrouping.

  • When in a fire fight, kill as many as you can, the one you miss may not miss tomorrow.

Laws of War for Helicopters

  • Helicopter tail rotors are naturally drawn toward trees, stumps, rocks, etc.
    While it may be possible to ward off this event some of the time, it cannot, despite the best efforts of the crew, always be prevented.
    It’s just what they do.
  • The engine RPM and the rotor RPM must BOTH be kept in the GREEN.
    Failure to heed this commandment can adversely affect the morale of the crew.
  • The terms Protective Armor and Helicopter are mutually exclusive.
  • “Chicken Plates” are not something you order in a restaurant.
  • The BSR (Bang Stare Red) Law:
    The louder the sudden bang in the helicopter, the quicker your eyes will be drawn to the gauges.
    Corollary: The longer you stare at the gauges the less time it takes them to move from green to red.
  • Loud, sudden noises in a helicopter WILL get your undivided attention.
  • The further you fly into the mountains, the louder the strange engine noises become.
  • It is a bad thing to run out of airspeed, altitude and ideas all at the same time.
  • “Pucker Factor” is the formal name of the equation that states the more hairy the situation is, the more of the seat cushion will be sucked up your butt.
    It can be expressed in its mathematical formula of:
    S (suction) + H (height above ground) + I (interest in staying alive) + T (# of tracers coming your way).
    Thus the term ‘SHIT!’ can also be used to denote a situation where a high Pucker Factor is being encountered.
  • Running out of pedal, fore or aft cyclic, or collective are all bad ideas.
    Any combination of these can be deadly.

Laws of War for Tanks

  • The same gun tube that would probably stay in alignment after lifting a car, will get you beaten after calibration if used to assist in climbing on the tank.

Law of Fighting Airplanes

  • The enemy is always has the advantage.
  • Heat-seeking missiles don’t know the difference between friend and foe.
  • ‘Armor’ is a fantasy invented by your C.O. to make you feel better.

  • IED’s will be placed frequently in the same spots over and over again.
  • Always shoot the guy walking down the MSR in the middle of the night carrying a gas can and a shovel. If they can’t place the IED’s, they can’t blow you up!

Hudud For sharing...

Tujuan Hukuman Hudud, Qisas, Diyat dan Ta’zir

Hukuman hudud, qisas, diyat dan ta`zir diperuntukkan dalam qanun jenayah syariah adalah bertujuan untuk menjaga prinsip perundangan Islam yang tertakluk di bawahnya lima perkara:

1. Menjaga agama, iaitu menjaga aqidah orang-orang Islam supaya tidak terpesong dari aqidah yang sebenar dan tidak menjadi murtad. Orang yang murtad akan disuruh bertaubat terlebih dahulu dan sekiranya dia enggan bertaubat maka hukuman bunuh akan dikenakan ke atas mereka.

Sabda Rasulullah s.a.w. yang bermaksud:“Sesiapa yang menukar agamanya (murtad), maka bunuhlah dia.” (Riwayat Bukhari)

2. Menjaga nyawa, iaitu menjaga jiwa seseorang dari dibunuh termasuklah menjaga anggota tubuh badan seseorang dari dicederakan atu dirosakkan. Sesiapa yang membunuh manusia atau mencederakan anggota tubuh badan mereka itu dengan sengaja wajib dijatuhkan hukuman qisas atau diyat sebagaimana firman Allah s.w.t. yang bermaksud:

“Dan di dalam hukum qisas itu ada jaminan hidup bagi kamu, wahai orang-orangyang berakal fikiran supaya kamu bertaqwa.” (Surah Al-Baqarah, 2:179)

3. Menjaga akal fikiran, iaitu memelihara akal fikiran manusia dari kerosakandisebabkan minum arak atau minuman-minuman yang memabukkan. Mereka yangmeminum arak wajib dijatuhkan hukuman sebat tidak lebih dari lapan puluh kalisebat sebagaimana yang telah diriwayatkan oleh Saiyidina Ali di dalam sebuah hadith yang bermaksud:“Rasulullah s.a.w. telah menyebat orang yang minum arak sebanyak empat puluhkali sebat, dan Saiyidina Abu Bakar telah menyebat empat puluh kali sebat juga, dan Saiyidina Umar menyebat sebanyak lapan puluh kali .

4. Menjaga keturunan, iaitu memelihara manusia dari melakukan perzinaan supayanasab keturunan, perwalian dan pewarisan anak-anak yang lahir hasil daripersetubuhan haram itu tidak rosak. Orang yang melakukan perzinaan wajibdijatuhkan hukum sebat dan rejam sebagaimana sabda Rasulullah s.a.w. dalamhadithnya yang diriwayatkan daripada `Ubadah bin As-Somit r.a. yang bermaksud:

“Ambillah peraturan daripada aku, ambillah peraturan daripada aku. SesungguhnyaAllah telah memberi jalan untuk mereka. Perawan dengan jejaka yang berzinahukumannya disebat sebanyak seratus kali sebat, dan dibuang negeri selamasetahun. Dan janda dengan janda yang berzina hukumannya disebat sebanyakseratus kali sebat dan direjam.” (Riwayat Muslim dan Abu Daud)

5. Menjaga harta benda, iaitu memelihara harta benda manusia dari dicuri dandirompak dengan menjatuhkan hukuman potong tangan ke atas pencuri, danmenjatuhkan hukuman mati atau potong tangan dan kaki kedua-duanya sekali ataudibuang negeri ke atas perompak. Hukuman ini tertakluk kepada cara rompakan itudilakukan sebagaimana firman Allah s.w.t. yang bermaksud:

“Dan orang lelaki yang mencuri dan perempuan yang mencuri maka (hukumannya)potonglah tangan mereka sebagai satu balasan dengan sebab apa yang merekatelah usahakan, (juga sebagai) suatu hukuman pencegah dari Allah. Dan (ingatlah)Allah maha Kuasa lagi Maha Bijaksana.” (Surah Al-Ma’idah: 38)Firman Allah s.w.t. lagi yang bermaksud:

“Sesungguhnya balasan orang-orang yang memerangi Allah dan RasulNya sertamelakukan bencana kerosakan di muka bumi (melakukan keganasan merampas dan membunuh orang di jalan ) ialah dengan balasan bunuh (kalau mereka membunuh sahaja dengan tidak merampas), atau dipalang (kalau mereka membunuh dan merampas), atau dipotong tangan dan kaki mereka dengan berselang (kalau mereka merampas sahaja, atau dibuang negeri (kalau mereka hanya mengganggu ketenteraman awam). Hukuman yang demikian itu adalah suatu kehinaan di dunia bagi mereka, dan di akhirat kelak mereka beroleh azab siksa yang amat besar.”(Surah Al-Ma’idah: 33)

HUKUM JENAYAH ISLAM

1. Pengertian Jenayah.Melakukan sesuatu perkara yang ditegah oleh Allah S.WT. atau meninggalkansesuatu perkara yang disuruh olehNya.

2. Falsafah Jenayah.Peraturan yang telah ditetapkan oleh Allah S.WT. untuk dilaksanakan dalamsesebuah negara bagi menjamin keadilan dan keselamatan ummah

HUKUM-HUKUM JENAYAH ISLAMHukum-hukum jenayah Islam terbahagi kepada ;(a) Hukum Hudud

(b) Hukum Qisas

(c) Hukum Ta'zir

A. HUKUM HUDUD

1. Pengertian Hudud;

(a) Dan segi bahasa hudud bererti menahan atau mencegàh.

(b) Dan segi segi istilah hudud ditakrifkan sebagai keseksaan yang telah ditetapkan oleh nas-nas Al-Quran dan AsSunnah yang wajib dilaksanakan sebagai hak Allah S.W.T. Kadar hukumannya tidak boleh dipinda sama ada dikurang atau ditambah.

Maksudnya; "Itulah hukum-hukum yang telah ditentukan. Oleh itu janganlah kamu mencabulnya, dan sesiapa yang mencabuli hukum-hukum Allah, maka mereka itulah orang-orang yang zalim"

2. Jenis-jenis jenayah hudud dan hukumannya

(a) Zina; Persetubuhan haram tanpa nikah yang sah antara lelaki dengan perempuan.

Hukuman : Bagi penzina yang belum berkahwin hukumannya ialah sebat 100 kali. Bagi penzina yang telah berkahwin hendaklah direjam sehingga mati.

(b) Qazaf (menuduh zina);Melemparkan tuduhan zina tanpa bukti terhadap orang yang baik.

Hukuman : sebat 80 kali

(c) Minum arak;Meminum minuman yang memabukkan dan boleh menghilangkan kewarasan akal.

Hukuman : sebat 80 kali

(d) Mencuri;Mengambil harta orang lain secara senyap atau sembunyi.

Hukuman : potong tangan

(e) Merompak;Mengambil harta orang lain dengan menggunakan kekerasan, paksaan, ugutan danancaman.

Hukuman : sekiranya membunuh hendaklah dibunuh

* sekiranya hanya merompak sahaja hendaklah dipotong tangan dan kakinya secara bersilang iaitu tangan kanan dan kaki kiri dan seterusnya kaki kanan dan tangan kiri bagi kesalahan seterusnya.*sekiranya hanya menganggu ketenteraman awam hendaklah dipenjara

(f) Riddah (murtad)Keluar seseorang Islam itu dan agama Islam sama ada dengan perbuatan dan perkataan.

Hukuman : Bunuh ( setelah diberi tempoh bertaubat selama 3 hari @ 3 kali )

# Semua jenayah hudud yang telah sabit kesalahannya wajib dikenakan hukuman hudud tanpa sebarang pengurangan @ pindahan kepada hukuman yang lain spt penjara @ wang.

B. HUKUM QISAS

1. Pengertian qisas;

(a) Dan segi bahasa qisas bermaksud memotong.

(b) Dan segi syarak bererti hukuman yang ditetapkan oleh syarak melalui nas-nas A1-Quran dan Hadis-hadis Nabi saw. kerana kesalahan-kesalahan yang melibatkan hak individu.

2. Jenis jenayah qisas;

Kesalahan-kesalahan yang diwajibkan hukuman qisas ialah membunuh dengan sengaja dan mencederakan anggota tubuh badan seperti mencederakan mata, hidung dan telinga.

3. Hukuman terhadap kesalahan qisas;

Mengikut hukum qisas seseorang penjenayah mesti diikuti dengan hukuman yang sama sepertimana dia lakukan ke atas mangsanya. Kalau ia membunuh maka dia mesti dihukum bunuh.

Maksudnya; "Dan Kami telah tetapkan atas mereka di dalam Kitab Taurat itu, bahawa jiwa dibalas dengan jiwa, dan mata dibalas dengan mata, dan hidung dibalas dengan hidung, dan telinga dibalas dengan telinga, dan gigi dibalas dengan gigi dan luka-luka hendaklah dibalas (seimbang). Tetapi sesiapa yang melepaskan hak membalasnya maka menjadilah ia penebus dosa baginya" (Surah al-Maidah ayat 45).

Diat

Diat adalah denda yang wajib dibayar kerana kesalahan jenayah sebagai ganti qisas.

Kadar Diat

Kadar diat adalah dikira mengikut bilangan unta iaitu harta yang paling bernilai ketika itu.Kadar penuh diat ialah 100 ekor unta. Walau bagaimanapun, para ulama' berpendapat boleh mengantikan 100 ekor unta dengan harta yang senilai dengannya pada masa tersebut. Di antaranya ialah

a) wangemas = 1000dinar

b) wangperak = 10,000-12,000dirham

c) lembu = 200ekord) kambing = 2000ekor

e) Persalinan = 200 persalinan lengkap

a. Diat jenayah membunuh.1. Pembunuhan sengaja - 100 ekor unta secara terus (tanpa tangguh) yang terdiri drp ;

A) 30ekor Juz'ah ( unta berumur 5 tahun)

B) 30 ekor Hiqqah (unta berumur 4 tahun)

C) 40 ekor Hulqah

# Bagi jenayah membunuh dengan sengaja, ada dua hukuman iaitu qishas @ diat. Diat hanya boleh dilaksanakan jika dipersetujui oleh waris. Jika tidak, qishas bunuh dikenakan.

2. Pembunuhan separuh sengaja - 100 ekor unta spt di atas tetapi bayaran bolehditangguhkan sehingga 3 tahun.

3. Pembunuhan tidak sengaja - 100 ekor unta dan ditangguhkan sehingga 3 tahunyang terdiri drp ;

20 ekor Juz'ah (unta berumur 5 tahun)

20 ekor Hiqqah (unta berumur 4 tahun)

20 ekor Bintu Labun (unta betina berumur 3 tahun)

20 ekor Ibnu Labun (unta berumur 3 tahun)

20 ekor Bintu Mukhad (unta betina berumur 2 tahun)

# Hukuman bagi jenayah Pembunuhan separuh sengaja dan Pembunuhan TidakSengaja adalah Diat sahaja. Qishas tidak dikenakan

1/2 drp diat lelaki

1/2 drp diat merdeka

# Pembunuhan Sengaja ialah membunuh dengan niat.

# Pembunuhan Separuh Sengaja ialah spt seorang memukul orang dengan tongkat @ melempar dengan batu kelikir, tanpa disangka-sangka terus mati orang tersebut. (tanpa niat membunuhnya)

# Pembunuhan Tidak Sengaja ialah spt seorang yang tertembak rakannya yangdisangkanya binatang buruan.

# Bagi jenayah membunuh, pembunuh hanya boleh diampunkan oleh warisnyasahaja. Pemerintah tidak ada kuasa dlm pengampunan.

b. Diat jenayah mencederakan anggota

1. 100 ekor unta untuk anggota tunggal spt terputusnya lidah, hilang akal,menyebabkan lumpuh seluruh anggota badan dan hilang keupayaan bersetubuh.

2. 50 ekor unta untuk anggota yang berpasangan, jika kedua-duanya terlibat maka diatnya 100 unta. Ia melibatkan salah satu drp kaki atau tangan, mata dan telinga.

3. 33 ekor unta untuk luka al-Ja'ifah (luka hingga ke dlm bhg otak)

4. 33 ekor unta untuk luka Al-Ma'muumah ( luka yang sampai ke selaput kepala)

5. 25 ekor unta untuk anggota yang 4 bahagian (pasang) spt kelopak mata. Setiapsatu kelopak mewakili 25 unta.

6. 10 ekor unta untuk luka Al-Hasyimah (luka yang memecah @ mematahkantulang)

7. 15 ekor unta untuk luka Al-Munqilah (luka yang sampai ke tulang danmematahkannya sehingga tergeser dari tempatnya).

8.10 ekor unta untuk anggota yang ada 10 bahagian spt jari tangan dan jari kiri.Setiap satu jari jika patah mewakili 10 ekor unta.

9. 5 ekor unta untuk luka Mudhihah @ Muwadhdhohah (luka yang menampakkantulang)

C. HUKUM TA'ZIR

1. Pengertian ta'zir.

(a) Dan segi bahasa ta'zir bererti menolak atau menghalang

(b) Dan segi istilah ialah hukuman yang dikenakan ke atas orang yang membuat kesalahan dan maksiat atau orang yang mencuaikan kewajipan yang tidak ditetapkan hukuman keseksaannya di dalam Al-Quran dan Hadis atau hukuman yang dikenakan ke atas orang yang melakukan jenayah yang telah ditetapkan keseksaannya, tetapi tidak cukup syarat bagi mengenakan keseksaan itu

2. Kesalahan-kesalahan yang termasuk di bawah kategoni ta'zir;

(a) Kesalahan-kesalahan hudud atau qisas yang tidak cukup bukti untuk dikenakanhukuman hudud atau qisas.

(b) Kesalahan-kesalahan khalwat, mencuri yang tidak cukup nisab dan sebagainya.

(c) Perbuatan-perbuatan yang boleh mengganggu ketenteraman awam sepertimengumpat, menipu, berjudi, rasuah, mengedar dan penyalahgunaan dadah.

3. Hukuman bagi kesalahan ta'zir.

(a) NasihatMenasihati orang yang melakukan kesalahan kecil bagi pertama kali agar ia tidak mengulangi lagi pada masa akan datang

(b) TeguranTeguran rasmi yang dilakukan oleh hakim dengan mengeluarkan ucapan-ucapan atau melakukan sesuatu tindakan tertentu agar orang yang melakukan kesalahan akan berusaha untuk memperbaiki dirinya

(c) AncamanMengancam orang yang bersalah agar tidak mengulangi kesalahannya di atas sebab takut dikenakan hukuman.

(d) PemulauanHukuman pemulauan dikenakan kepada pesalah agar ia berasa tersempit sekiranya ia berterusan atau mengulangi kesalahannya lantaran tidak dapat bermuamalat dengan orang lain dalam masyarakat

(e) Perisytiharan umumMembuat pengisytiharan kepada umum terhadapkesalahan penjenayah. Dengannyapenjenayah berasa tertekan dan malu yang amat sangat

(f) Denda dan merampas harta;Iaitu hukuman ta 'zir dengan denda berbentuk kewangan dan merampas harta yang dimiliki oieh penjenayah.

(g) Penjara;Mengenakan hukuman penjara dalam tempoh tertentu mengikut pertimbangan realiti semasa.

(h) Sebat;Mengenakan hukuman sebat kepada penjenayah dengan jumlah sebatan yang tertentu mengikut realiti sekali

(i) BunuhHukuman bunuh bagi kesalahan ta'zir dibenarkan oleh syarak bagi menjagakemaslahatan umum masyarakat

(j) Buang daerahHukuman ini dikenakan supaya penjenayah berasa tertekan, mengalami kesusahandan tersisih akibat dipisahkan dari kaum keluarga dan sahabat handai.

Matlamat Hukum Hudud, Qisas dan Ta'zir

(a) untuk melindung masyarakat daripada bahaya jenayah dan mencegah sebelum ia berlaku.

(b) untuk memperbaiki penjenayah dan membetulkan penyelewengan. Ini dapat dilihat daripada kesan yang ditinggalkan oleh hukuman ke atas penjenayah yang memberi pengajaran, memperbaiki dan menghalang seseorang daripada melakukan jenayah

(c) untuk membersih dosa penjenayah dan menyelamatkannya daripada azabakhirat. Peranan undang-undang jenayah Islam mewujudkan keamanan dan kesejahteraan dalam masyarakat.

(a) Undang-undang jenayah Islam menjatuhkan hukuman secara adil dan saksama. Misalnya orang yang membunuh dihukum bunuh balas. Ini menyebabkan warisnya berpuas hati dan hilang perasaan dendam.

(b) Hukuman jenayah Islam yang kemas dan tegas menyebabkan penjenayah dan orang ramai takut dan gerun untuk mengulangi jenayah. Akhirnya kehidupan masyarakat aman dan sejahtera.

(c) Hukuman jenayah Islam mengandungi unsur-unsur pendidikan kepada penjenayah dan orang ramai. Hukuman yang dikenakan mendorong seseorang penjenayah bertaubat dan menyesali kesalahan yang dilakukannya. Dengan ini jenayah akan berkurangan dalam masyarakat.

1. Insiden yang berlaku pada akhir April lepas menarik minat saya untuk membuka kamus isu-isu di kepulauan Spratly, untuk mengetahui apakah insiden itu yang menyebabkan kekuatan Tentera Laut Di Raja Malaysia (TLDM) dan pesawat Tentera Udara Di Raja Malaysia (TUDM) dikejarkan ke sana.

2. Terdapat tanda-tanda negara China yang kini sudah mula diperkuat dengan armada laut yang canggih dan pesawat terbaru seperti Sukhoi dan J-10 sudah mula menjalankan gerakan-gerakan untuk menguatkan tuntutannya ke atas kepulauan Spratly dengan lebih agresif.

3. Penganalisis pertahanan dan sains politik dunia sudah sejak sekian lama meramalkan konflik terbaru yang dijangka lebih hebat dari isu kepulauan Falklands akan meletus di Laut China Selatan, khususnya kerana terdapat tuntutan bertindih di antara China, Vietnam, Filiphina, Indonesia, Brunei dan Malaysia.

4. Ia bukan sahaja kaya dengan telaga minyak tetapi merupakan sumber makanan dan ekonomi yang penting, ia mewah dengan perikanan.

KUBU PERTAHANAN DI KEPULAUAN SPRATLY

5. Untuk menguatkan lagi tuntutan dan penguasaan Malaysia ke atas kepulauan ini, bertan-tan tanah dari Sabah di bawa untuk menambak Terumbu Layang-layang menjadi sebuah pulau buatan (14 kilometer persegi) dan dilengkapi dengan landasan pesawat.

6. Pulau Layang-layang ini dilengkapi dengan radar, stesyen pasukan khas serta landasan yang sesuai untuk pesawat dari jenis Short Take Off Landing (STOL) seperti CN235 dan C130.

7. Malaysia turut mempunyai kubu pertahanan yang lengkap dengan meriam serta “helipad” di Terumbu Ubi dan Terumbu Mantanani.

8. Filiphina turut mempunyai kubu tenteranya di Pulau Pag-Asa yang dilengkapi dengan landasan pesawat yang dikendalikan oleh Sayap Komposit Taktikal 570th.

9. China walaupun tidak mempunyai pengkalan yang besar di kawasan kepulauan Spratly, ia bagaimanapun mempunyai binaan setinggi 3 tingkat bangunan di Terumbu Mischief.

10.Ia juga dilengkapi dengan padang bola jaring, binaan seperti parabola, lampu suar, panel solar dan sejenis radar.

11.Negara itu mempunyai kubu yang kukuh di kawasan Terumbu Johnson, binaan di situ dilengkapi dengan mesin gun berkuasa tinggi dan meriam. Kapal perang China dari jenis friget Jiangwei pernah berlabuh di kawasan ini pada April 2009.

12.Vietnam pula turut mempunyai kubu tentera di Pulau Lagos dengan binaan seperti landasan pesawat, jeti dan sekurang-kurangnya 35 buah bangunan ketenteraan yang dikawal dengan pelbagai jenis senjata termasuk lima kereta kebal.

13.Penulis tidak berminat untuk menyentuh kedudukan tentera oleh negara lain di kepulauan Spratly tetapi hanya menumpukan kepada empat sahaja iaitu Malaysia, China, Vietnam dan Filiphina.

STRATEGI MALAYSIA

14.Malaysia membawa pembangunan yang paling pesat di kepulauan itu berbanding negara lain, Filipina menguasai pulau yang paling besar di kepulauan Spratly tetapi kesemua negara lain hanya memiliki terumbu-terumbu kecil sahaja sehinggalah Malaysia membawa masuk bertan-tan pasir untuk mengubah Terumbu Layang-layang menjadi sebuah pulau.

15.Kawasan tuntutan Malaysia juga mempunyai kadar simpanan minyak dan gas yang paling kaya berbanding kesemua kawasan lain di Spratly.

16.Malaysia turut membina pengkalan kapal selamnya di Teluk Sepanggar, Sabah sebagai persediaan menghadapi sebarang konflik di Spartly dan juga sebagai senjata cegah rintang apabila terpaksa menghadapi kekuatan yang besar seperti China.

17.Umum mengetahui, China mempunyai armada laut yang besar tetapi ia mempunyai kelemahan yang agak ketara dari segi kekuatan Peperangan Anti Kapal Selam.

18.Jarak operasi pesawat Sukhoi dan J-10 China untuk ke Spratly juga sangat jauh dan kuasa besar itu tidak mempunyai kapal induk pesawat untuk menjalankan operasi ketenteraan secara berkesan.

19.Sebagai contoh, Britain dalam Krisis Falkland berjaya memenangi peperangan menuntut pulau Falkland dari Argentina kerana Britain mempunyai armada laut yang kuat termasuk dilengkapi dengan kapal induk pesawat seperti HMS Hermes.

20.Walaupun terletak beribu batu dari kawasan konflik, Britain akhirnya menang dan peranan kapal selam Britain berjaya mencegah campur tangan tentera laut Argentina menyebabkan negara Latin Amerika itu hanya sanggup menyediakan tentera udaranya sahaja untuk menghadapi Britain.

21.Kemasukkan pesawat-pesawat Sukhoi 30MKM menyediakan negara sistem pertahanan yang mempunyai kemampuan menguasai udara dari jarak yang jauh, umum mengetahui jarak penerbangan Sukhoi yang beroperasi dari Gong Kedak yang terletak berhampiran Laut China Selatan memungkinkan TUDM beroperasi untuk anti perkapalan dari perairan Vietnam, Filiphina sehinggalah ke Sabah.

INSIDEN DI SPRATLY

CHINA VS AS

22.Seperti yang saya katakan, kepulauan Spratly mempunyai potensi untuk merebak ke konflik yang lebih besar.

23.Pada 8 Mac 2009, lima buah kapal milik China iaitu sebuah kapal perisik, sebuah kapal jabatan laut China, sebuah kapal pengukur laut dan dua buah kapal nelayan laut dalam telah mengelilingi dan membuat gerakan-gerakan yang menganggu perjalanan sebuah kapal milik Amerika Syarikat (AS) iaitu USS Impeccable.

24.Insiden berlaku lebih kurang 75 batu dari selatan Pulau Hainan menyebabkan berlakunya “pertempuran” kecil dengan menggunakan meriam air (kapal AS ini tidak dilengkapi senjata api).

25.Kelasi China turut menanggalkan seluar dalam mereka dan melontarkan cangkuk untuk merosakkan peralatan survey kapal AS tersebut.

CHINA VS VIETNAM

26.Pada 14 Mac 1988, satu pertempuran kecil berlaku di antara tentera laut China dan Vietnam dalam satu insiden yang di namakan pertempuran di Terumbu Selatan Johnson.

27.Terumbu Johnson merupakan kawasan yang dikuasai oleh Vietnam (umum mengetahui bahawa Vietnam pernah terlibat dalam peperangan dengan China dan kedua-dua negara ini adalah seteru di antara satu sama lain walaupun China pernah membantu vietnam dalam peperanganya memerangi AS di antara tahun 60an dan 70an dahulu).

28.Menjelang akhir Januari 1988, Vietnam sudah mula mengesan kehadiran tentera China dan kapal perangnya di terumbu Johnson menyebabkan Vietnam turut menghantar tenteranya sebagai persediaan sebarang kemungkinan dengan seterunya itu.

29.Pada Mac 13, kapal perang China mengesan kehadiran kapal perang kecil Vietnam dengan nombor penan HQ-604 bergerak ke kawasan terumbu Johnson dan satu lagi kapal perangnya dengan nombor penan HQ-605 bergerak ke terumbu Lansdowne Reef.

30.Kapal perang Vietnam dengan nombor penan HQ-505 pula belayar ke arah Terumbu Collins, tiga pergerakan kapal yang dianggap sebagai pencerobohan ke dalam wilayah China.

31.Kapal perang China sebelum itu telah pun menurunkan 25 orang askar di kawasan terumbu Johnson dan sebuah lagi kapal perang China telah mendaratkan 33 tentera marin ke kawasan itu.

32.Kapal perang China iaitu Xiantan pula dikejarkan ke Terumbu Lansdowne.

33.Pada 14 Mac, jam 7.30 pagi, askar Vietnam dilihat sedang cuba menaikkan tiang bendera negara mereka di Terumbu Johnson Selatan.

34.Selepas terjadinya perang mulut di antara askar China dan Vietnam, pertengkaran itu bertukar menjadi pertempuran senjata api dan kapal perang Vietnam iaitu HQ 604 menawarkan tembakan bantuan.

35.Akibatnya, kapal perang China yang berada di kawasan berhampiran bertindak menembak HQ 604 sehingga kapal perang Vietnam itu terbakar dan tenggelam.

36.Di Terumbu Collins, kapal perang Vietnam iaitu HQ 505 turut musnah di tembak kapal perang Chin

37.Di Terumbu Lansdowne, kapal perang Vietnam, HQ 605 turut ditenggelamkan.

38.Melalui kemenangan ini, China berjaya menguasai tujuh terumbu di kawasan itu.

CHINA VS FILIPHINA

39.Pada tahun 1994, insiden pencerobohan yang serupa turut terjadi di antara tentera laut Filipina dengan kapal perang China.

40.Pencerobohan di lakukan oleh kapal perang China ke dalam kawasan Zon Ekonomi Eksklusif (EEZ) milik

41.Filipina yang diketahui mempunyai armada laut yang paling lemah di kalangan negara Asean bagaimanapun tidak mengarahkan kapal perangnya menembak atau melakukan provokasi ke atas kapal perang China itu.

42.Ini dibuat memandangkan kesanggupan China untuk memusnah atau menggunakan kekerasan ke atas sesiapa sahaja seperti yang terjadi pada Vietnam sedangkan pencerobohan secara jelas di buat oleh China.

43.Kapal perang Filipina kemudian melarikan diri dari bertembung dengan kapal perang China itu.

EKSKLUSIF DARI MOM – CHINA VS MALAYSIA

44.Insiden yang melibatkan kapal perang dan pesawat milik TUDM ini dilapor berlaku pada akhir April 2010.

45.Ia tidak dilapor dalam mana-mana media tempatan dalam negara tetapi menjadi tajuk utama dalam akhbar di China.

46.Laporan dari akhbar The Southern Daily (akhbar rasmi komunis China dalam bahasa Cina) bertarikh 1 Mei memberitahu, sekumpulan kapal perikanan China sedang menjalankan aktiviti pelayaran mereka di kepulauan Spratly yang dipanggil Nansha oleh pihak China.

47.Armada kapal-kapal perikanan China ini sebenarnya merupakan strategi China untuk menguatkan tuntutan dan penguasaan mereka ke atas seluruh pentas Laut China Selatan dan khususnya Spratly.

48.Pembaca sekelian, kapal-kapal perikanan China bukanlah seperti kapal-kapal dari Jabatan Perikanan Malaysia kerana kebanyakkan kapal-kapal perikanan China ini mempunyai keupayaan untuk belayar di laut dalam dan jauh dari pengkalan mereka.

49.Kapal-kapal ini ada di antara berat 1,400 tan sehingga 2,400 tan mempunyai besar yang hampir menyamai kapal korvet.

66.Pada tahun 2005, sebuah kapal perang Indonesia, KRI Tanjung Dalpele berjaya memintas empat buat kapal perikanan China yang mencari ikan secara haram di kawasan lautan Arafura yang terletak di antara Wilayah Papua dan Maluku.

China ban on fishing as tension runs high

China today launches its annual fishing ban in the South China Sea – a unilateral act that comes amid unprecedented tensions in the disputed area and fresh fears that Beijing is using the moratorium to assert its sovereignty claims there.

The mainland’s fisheries administration vessels will seek to enforce the 10-week ban on most kinds of commercial fishing from the 12th parallel north of the disputed Spratly Islands up to the Chinese coast, encompassing waters around the disputed Paracel Islands.

The ban is going ahead despite a diplomatic protest from Vietnam – which claims both island groups – and recent incidents involving intensified patrols by new Chinese fisheries protection ships, some of which are armed with heavy machine guns.

The incidents have included China’s largest fishing protection ship, the 4,600-tonne Yuzheng 311, being surrounded by more than 20 Vietnamese fishing and coastguard vessels last month as it attempted to stop harassment of Chinese fishing boats. The Yuzheng – a converted naval vessel – was also intercepted by Malaysian naval ships and aircraft as it patrolled south of the Spratlys late last month, according to mainland press accounts.

Reports of mainland fishermen facing harassment from Vietnam, the Philippines and Malaysia were cited as justification for the expanded mainland patrols earlier this year.

In March, China also staged its most extensive naval and air exercises yet over the South China Sea.

Vietnam’s state press is filled with reports of local fishermen insisting they will continue to assert their fishing rights, including around the Chinese-controlled Paracels, and demanding more government protection.

Diplomats and analysts are closely watching the situation, noting the ban risks feeding into worsening tensions as regional militaries react to China’s naval build-up.

The South China Sea is considered critical to its blue-water naval ambitions. It is home to bases on Hainan Island that can exploit deep-water access to the Indian and Pacific oceans. The sea also has oil and gas potential.

When China first instituted the ban in 1999 in a bid to ease pressure on rapidly declining fish stocks, it received relatively little attention. Now, however, it is a different story given growing pressures on resources as well as its strategic importance.

China claims an exclusive economic zone (EEZ) covering much of the South China Sea, including the Spratlys and Paracels in their entirety. Vietnam also claims all of both archipelagoes; the Philippines, Malaysia and Brunei claim them in part.

“We are all watching and wondering where all this is going to go,” said one senior regional envoy. “Given recent months, you have to say it does appear provocative ? certainly it provides further evidence that any hope of a binding regional agreement to ease tensions in the South China Sea is now effectively a dead letter.

“What we are seeing is a push for sovereignty.”

In a recent survey of China’s growing coastguard forces, Lyle Goldstein, a scholar at the US Naval War College, noted the potential of civilian ships to project soft power but also “serve to strengthen China’s extensive maritime claims”.

“More and better ships at Beijing’s disposal will likely increase its confidence in maritime disputes with its neighbours,” Goldstein wrote.

Australian Defence Force Academy professor Carl Thayer, who has tracked South China Sea issues for four decades, said he had little doubt the fishing ban served a wider strategic objective.

“After 10 years, we can see China becoming more assertive in defending and projecting what it sees as its sovereign and economic rights,” Thayer said.

“The use of fishing protection vessels is an excellent tactic ? They are not warships, they are painted white not grey, but make no mistake, they are well armed.

“The problem is that it is not really the kind of unilateral activity that China and the region signed up for in terms of fostering co-operation and not doing anything to raise tensions,” Thayer said, referring to the landmark 2002 declaration on the South China Sea between China and the Association of Southeast Asian Nations.

Mainland officials and analysts, however, have cited both fishing and sovereignty issues as driving the ban.

Wang Hanling , an expert in maritime affairs and international law at the Chinese Academy of Social Sciences, said there was no strategic goal behind the ban.

“China just wants to protect fishing resources under its exclusive economic zone,” he said.

“In fact, we don’t need to take any strategies because China insists that we had sovereign rights and administration in our EEZ in the South China Sea more than 1,000 years ago, which was recognised by our neighbours like Vietnam, Indonesia, but they tore up the agreement in the 1970s when oil and other resources were found under the water.

“We have carried [out] fishing bans many years ago as it is an international common practice.”

When regular fishing patrols were announced in March, however, South Sea Fisheries Administration officials said the move would help underline China’s sovereign rights.

Gary Li, a PLA-watcher at London’s International Institute of Strategic Studies, said he believed the fishing ban now served to create de facto jurisdiction for a Beijing leadership that had been slow to develop resources in the South China Sea. “It does have a strategic purpose beyond the issue of fishing ? the leadership is desperately trying to create historical precedent, hoping to show that they are largely unchallenged in asserting their sovereignty,” he said.

The situation is widely believed to be particularly thorny for Vietnam, which is struggling to promote regional interest in strengthening the 2002 agreement into a legally binding document.

Hanoi’s Communist Party leaders are eager for improved relations with Beijing, its one-time enemy, yet are loath to back down on what they perceive as core territorial issues.

Those contradictions have seen Hanoi accept joint exercises with Chinese vessels in areas of the Tonkin Gulf no longer in dispute, yet also authorise its own naval expansion.

Vietnam announced late last year that it would spend more than US$2 billion on ultra-quiet Kilo-class submarines from Russia – successor to its former cold war patron, the Soviet Union.

Komando : Peralatan kita ketinggalan zaman. Itu satu kelebihan dan juga kelemahan.
